XMODhub Game Modifier License and Services Agreement

This Agreement is entered into by and between you and Larvas Limited, the provider of the XMODhub Game Modifier Services, and constitutes a legally binding contract. Please read all terms of this Agreement carefully. If you agree to this Agreement, you may continue to use the services provided through the XMODhub Game Modifier. By clicking “Agree,” “Accept,” or “Next,” or by registering for or using the XMODhub Game Modifier, you are deemed to have read, agreed to, and executed this Agreement.

If you are under 18 years of age, please read this Agreement in the presence of your legal guardian. You may use the XMODhub Game Modifier Services only after obtaining your legal guardian’s consent, and you should pay particular attention to the provisions governing use by minors.

1. Definitions

1.1 “Agreement” means the main body of this Agreement, the User Rules, the XMODhub Game Modifier Privacy Protection Guidelines, and any amended versions thereof. Once officially published, all of the foregoing shall constitute integral parts of this Agreement.

1.2 “User Rules” means the announcements, prompts, notices, and other content regarding the XMODhub Game Modifier that XMODhub publishes and amends from time to time.

1.3 “XMODhub Game Modifier Services Provider” means Larvas Limited, which provides you with the XMODhub Game Modifier and related services, and is referred to in this Agreement as “XMODhub,” “we,” “us,” or “our.”

1.4 “XMODhub Game Modifier” means the game modification software developed and operated by XMODhub, together with the related documentation.

1.5 “XMODhub Game Modifier Services” means the various services that XMODhub provides to you through the XMODhub Game Modifier.

1.6 “You,” also referred to as a “Player” or “User,” means the natural person authorized to use the XMODhub Game Modifier and its services.

1.7 “Single-Player Game Data” means all data contained in copies of single-player games that you have purchased, downloaded, and stored in local files, as well as all data generated while you play various single-player games, including, without limitation, character data and virtual item data.

1.8 “AI Assistant” means the artificial intelligence question-and-answer feature embedded in the XMODhub Game Modifier client, which uses open-source large-model technology to provide users with automated answers containing information such as game guides.

2. XMODhub Game Modifier Account

2.1 To use the XMODhub Game Modifier Services, you must register for an XMODhub Game Modifier account.

2.2 In accordance with applicable national laws and regulations, you shall complete registration using your real identity. When completing real-name registration, you shall provide true, lawful, accurate, and valid identity information and other relevant information concerning yourself, and you must not use another person’s identity information for real-name registration.

2.3 An XMODhub Game Modifier account is the identifier and credential that XMODhub authorizes you to use, in accordance with this Agreement, to log in to and use the XMODhub Game Modifier and related services. Ownership of the account belongs to XMODhub. You have only the right to use the account in accordance with this Agreement. You must not make the account available to any other person in any manner, including, without limitation, by transferring, renting, or lending it to another person for commercial use. Otherwise, you shall bear all legal consequences and liabilities arising therefrom, and XMODhub shall be entitled to take measures against your account, including, without limitation, issuing a warning; restricting or prohibiting the use of all or part of the account’s functions; deleting the account and other related information; suspending the account; or canceling the account. You shall bear all consequences arising therefrom.

2.4 You fully understand and agree that XMODhub shall be entitled to verify, as required by laws and regulations, whether the identity information provided during user registration is true and valid, and shall proactively adopt reasonable technical, administrative, and other measures to safeguard the security and validity of user accounts. Users are obligated to properly safeguard their accounts and passwords and to use them correctly and securely. If your account is found to be potentially subject to any abnormal condition or risk, XMODhub shall be entitled to reverify your account in accordance with applicable laws and regulations. If either party fails to fulfill the foregoing obligations and thereby causes loss of an account or password, theft of an account, or any other circumstance that harms the civil rights of a user or another person, the party that failed to fulfill its obligations shall bear the resulting legal liability.

2.5 Account Security and Risk Control

2.5.1 You fully understand and agree that your XMODhub Game Modifier account is for your personal use only. You must not make the account available to any third party in any form, including, without limitation, by sharing, lending, renting, transferring, selling, or authorizing another person to use it, nor may you log in to or use our services through another person’s account.

2.5.2 To protect the security of your account and prevent risks such as fraud, malicious sharing, and account abuse, you agree to and authorize XMODhub to conduct security checks and risk assessments on account login activity. We may collect and analyze the following information: login device information (including device model and device identifier), login IP address, login location (an approximate geographic area inferred from the IP address), login time, login frequency, device changes, changes in network environment, and other relevant information. The collection and use of the foregoing information shall comply with the applicable provisions of the XMODhub Game Modifier Privacy Protection Guidelines.

2.5.3 If any of the following abnormal circumstances occurs in connection with your account, including, without limitation, frequent logins from different devices or IP addresses within a short period; abnormal changes in login location, whether across regions or countries; login activity that materially deviates from your prior patterns; indications that the account is being used by multiple persons or on a rotating basis; suspected rental, lending, or transfer of the account; or any other circumstance indicating that the account may not be under your control or may present a security risk, XMODhub shall be entitled to take corresponding security measures based on the level of risk, including, without limitation:

1. Requiring you to complete additional security verification, such as SMS verification or identity verification;

2. Temporarily restricting or prohibiting login to your account;

3. Restricting the use of some or all account functions;

4. Freezing the account until the risk has been resolved; or

5. Requiring you to contact customer service for manual verification.

2.5.4 After restrictions have been imposed on your account, you may apply through customer service to have them removed. After verifying your identity, we will determine, in light of the actual circumstances, whether to remove the restrictions. You shall bear all losses arising from any account restriction or use by another person caused by reasons attributable to you, including, without limitation, sharing, lending, or renting the account.

2.6 Where XMODhub provides an account cancellation function, if you need to cancel your XMODhub Game Modifier account, you may follow the account cancellation instructions provided by XMODhub and must ensure that you satisfy the applicable account cancellation conditions published by XMODhub.

You are also specifically advised that, if you cancel your account, all value-added services under that game account will also be removed. Accordingly, once you cancel your account, any unused value-added services remaining under the account at that time will be deemed voluntarily relinquished by you, and XMODhub shall be entitled to delete all data under that account. You shall bear the consequences arising therefrom.

3. Collection, Use, and Protection of User Information

3.1 You agree to and authorize XMODhub to collect your personal information for the purpose of performing this Agreement. In the course of your use of the XMODhub Game Modifier Services, XMODhub will, in the manner specified in the XMODhub Game Modifier Privacy Protection Guidelines, collect information that you voluntarily provide when using the services or that is generated through your use of the services, in order to provide and optimize our services and protect the security of your account.

3.2 XMODhub respects and protects users’ personal information and privacy. The collection, use, and protection of users’ personal information by the XMODhub Game Modifier shall comply with the XMODhub Game Modifier Privacy Protection Guidelines. If you have consented to XMODhub’s processing of your personal information pursuant to the foregoing agreement or rules and subsequently withdraw your consent, then, as provided by law, your withdrawal of consent will not affect the validity of any personal information processing conducted on the basis of your consent before such withdrawal.

3.3 You acknowledge and agree that, in order to ensure the secure and stable operation of the XMODhub Game Modifier and enable specific functions, XMODhub may share necessary information concerning you with its affiliates or third-party partners. Details of such sharing are set forth in the List of Information Shared with Third Parties. XMODhub will urge the relevant third parties to process your personal information in accordance with the Privacy Protection Guidelines and applicable agreements.

4. XMODhub Game Modifier Services

4.1 Subject to your compliance with this Agreement and applicable laws and regulations, XMODhub grants you a personal, non-transferable, and non-exclusive license to use the XMODhub Game Modifier Services. You may use the XMODhub Game Modifier Services solely for noncommercial purposes, including:

1. Receiving, downloading, installing, launching, upgrading, logging in to, and running the XMODhub Game Modifier;

2. Setting a username, viewing user profiles, purchasing and using value-added services, using chat functions, and using social-sharing functions;

3. Automatically detecting and identifying single-player games installed locally on your device across multiple supported platforms, including Steam and Epic; providing functions including, without limitation, game modification, Mod loading, and text translation; and supporting automatic updates to the game modifier in step with game-version updates; and

4. Using one or more other functions supported and permitted by the XMODhub Game Modifier.

4.2 IMPORTANT NOTICE: The XMODhub Game Modifier does not provide any services for online games.

4.3 You fully understand and agree that the XMODhub Game Modifier Services do not provide downloads or activation for any game, nor do they sell any game key (CDKEY). Before using the XMODhub Game Modifier Services, you shall independently purchase and obtain the right to use the applicable game and ensure that the complete files for that game, downloaded through lawful channels, are stored in your local files. Otherwise, the XMODhub Game Modifier will be unable to provide services to you.

4.4 Disclaimer and Undertaking Regarding Modification of Single-Player Game Data: Users shall strictly comply with the game rules established by the developers and publishers of single-player games and shall engage in responsible gaming. Use of the XMODhub Game Modifier Services may result in changes to Single-Player Game Data stored in your local files. If you choose to use the XMODhub Game Modifier Services, you irrevocably undertake not to require XMODhub to bear any liability for changes to Single-Player Game Data caused by your use of the XMODhub Game Modifier Services, including liability for restoring data or compensating losses.

4.5 XMODhub’s provision of the XMODhub Game Modifier Services to users is itself a commercial activity. Users shall be entitled to decide independently whether to pay the applicable fees, based on the fee-based items and fee standards independently determined by XMODhub, in order to obtain the corresponding services. If you do not pay the applicable fees in accordance with the corresponding standards, you will not be able to obtain the corresponding services.

You acknowledge and agree that changes or adjustments to fee-based items or fee standards constitute normal commercial conduct, and you must not require XMODhub to provide damages or compensation on account of any such change or adjustment.

4.6 AI Assistant Services

4.6.1 XMODhub provides an AI Assistant function (the “AI Assistant”) that offers users question-and-answer services containing information such as game guides. The AI Assistant is technically supported by open-source large models deployed by XMODhub and obtains relevant information through third-party search interfaces to assist in generating responses. You understand and agree that content generated by the AI Assistant is produced entirely and automatically using artificial intelligence technology, and XMODhub makes no express or implied warranty regarding the accuracy, completeness, timeliness, reliability, or suitability of any content generated by the AI Assistant.

4.6.2 Content Disclaimer. You fully acknowledge and agree that:

1. AI large-model technology has inherent limitations, including, without limitation, that it may generate content that is not entirely accurate, is incomplete or outdated, or does not meet expectations, and may produce responses that differ from what you expect;

2. Information such as game guides generated by the AI Assistant is for reference only and does not constitute professional advice or a basis for decision-making in any form. You shall independently decide, based on your own judgment, whether to adopt any relevant suggestion and shall bear all consequences arising therefrom;

3. XMODhub shall not bear any legal liability for any direct or indirect loss arising from your reliance on or use of content generated by the AI Assistant, including, without limitation, loss of game data, suspension of an account, or impairment of the gaming experience; and

4. Content generated by the AI Assistant may involve information relating to third-party games. XMODhub has not obtained authorization from any game developer or publisher. You shall independently assess and comply with the applicable game’s terms of service and rules of use.

4.6.3 User Compliance Obligations. When using the AI Assistant, you shall comply with applicable laws and regulations, public morals, and the applicable provisions of this Agreement, and you must not use the AI Assistant to:

1. Generate, disseminate, or store any content that violates applicable laws or regulations or contains illegal or harmful information;

2. Upload, enter, or submit any content that infringes the lawful rights and interests of any third party, including, without limitation, intellectual property rights, trade secrets, or personal information rights; or

3. Pursue any commercial purpose or engage in any form of commercial exploitation.

4.6.4 Special Notice Regarding Game Compliance. You understand and undertake that, when using the AI Assistant to obtain information such as game guides, you shall comply with the official terms of service, user agreement, and applicable rules of the game you play. The official terms of certain games may prohibit or restrict the use of any third-party program, automation tool, or auxiliary software to obtain in-game information or game guides. If your use of content generated by the AI Assistant violates a game’s official rules and results in any penalty against your game account, including, without limitation, account suspension, data rollback, or functional restrictions, you shall bear the relevant liability, and XMODhub shall bear no liability.

4.6.5 Service Suspension and Restrictions. If you violate the standards governing use of the AI Assistant under this Agreement, XMODhub shall be entitled, depending on the circumstances, to take one or more of the following measures: issue a warning; temporarily or permanently terminate your authorization to use the AI Assistant function; freeze or cancel your account; or hold you legally liable as appropriate. You shall indemnify XMODhub for any loss it incurs as a result of your noncompliant use of the AI Assistant.

4.6.6 When you use the AI Assistant, XMODhub will collect and use your query content, function usage logs, and interaction data in accordance with the XMODhub Game Modifier Privacy Protection Guidelines. Please note: do not enter or upload any content containing your sensitive personal information, such as your name, identification number, mobile telephone number, or bank account number, or any trade secret or other content that should not be made public.

5. Software License

5.1 Use of the XMODhub Game Modifier Services may require you to download and install relevant software. You may obtain the software directly from websites related to the XMODhub Game Modifier or from a third party authorized by XMODhub. If you obtain it from a third party not authorized by XMODhub, you will be deemed not to have obtained authorization from XMODhub. XMODhub cannot guarantee that such game modifier will function properly and will not be liable for any loss caused to you as a result.

5.2 After a new version of the XMODhub Game Modifier software is released, older versions of the software may no longer function. XMODhub does not warrant the continued availability of older versions or the availability of corresponding customer services. Please check for and download the latest version at all times.

6. User Conduct Rules

6.1 You fully understand and agree that you must be responsible for all conduct undertaken through your use of the XMODhub Game Modifier Services, including any content you publish and any consequences arising therefrom.

6.2 Except as permitted under this Agreement in connection with your use of the XMODhub Game Modifier Services, you must not engage in any conduct that infringes the lawful rights and interests of any other third party, including, without limitation:

1. Reverse engineering, decompiling, or disassembling the software;

2. Using the software to engage in any illegal activity or any activity that infringes another person’s rights; or

3. Interfering with or disrupting the normal operation of the services.

7. Intellectual Property

7.1 XMODhub is the owner of the intellectual property rights in the XMODhub Game Modifier. All copyrights, trademark rights, patent rights, trade secrets, other intellectual property rights, and other lawful rights and interests in the XMODhub Game Modifier are protected by applicable laws and regulations and relevant international treaties. XMODhub owns the foregoing intellectual property rights and lawful rights and interests, except for rights that the relevant right holders are entitled to enjoy in accordance with law. Without XMODhub’s prior written consent, you must not commercially use the XMODhub Game Modifier in any manner.

7.2 If the XMODhub Game Modifier Services involve any third-party intellectual property, before using the XMODhub Game Modifier Services, you shall obtain any valid authorization or consent required by the third party in relation to such intellectual property. Otherwise, XMODhub will refuse to provide services to you. You shall bear liability for any violation of the applicable requirements, and XMODhub shall be entitled to provide your information to the third party.

7.3 Intellectual Property in Content Generated by the AI Assistant

7.3.1 Content generated by the AI Assistant (“AI-Generated Content”) is produced automatically through artificial intelligence technology and does not constitute a work within the meaning of copyright law. The related rights and interests belong to XMODhub. However, if any AI-Generated Content is substantially similar to content in which a third party holds lawful rights, the applicable rights shall continue to belong to that third party. You must not use AI-Generated Content for any commercial purpose beyond the scope permitted under this Agreement or conduct any form of independent development or exploitation thereof.

7.3.2 The intellectual property rights in questions you enter, text you upload, and other content you provide when using the AI Assistant (“User Input Content”) shall continue to belong to you or the relevant right holder. You grant XMODhub a non-exclusive, royalty-free license, valid during the period in which the services are provided, to carry out necessary processing of User Input Content, including, without limitation, data cleaning, format conversion, and storage, for purposes of providing the AI Assistant Services. XMODhub will not use User Input Content for model training or provide it to any third party, unless otherwise provided by laws or regulations or separately authorized by you.

7.3.3 If you believe that any AI-Generated Content infringes your lawful rights and interests, including, without limitation, copyrights, trademark rights, or reputation rights, you may submit written notice to XMODhub through a complaint channel published by XMODhub. Following verification, XMODhub will take necessary measures in accordance with law, including, without limitation, deleting the relevant content or disabling links.

8. Membership Service Refund Rules

8.1 The refund rules set forth in this Section apply to all membership services provided on the XMODhub platform, including, without limitation, monthly, quarterly, annual, multi-year, and lifetime memberships, irrespective of the membership term.

8.2 If you apply for a refund during your use of membership services, the refundable amount shall be calculated according to the following formula:

Refundable Amount = Membership Service Fee Actually Paid by You − (Original Monthly Membership Price ÷ 30) × Number of Days Used

For purposes of this formula:

• “Original Monthly Membership Price” means the standard price for the monthly membership service published by XMODhub, excluding any preferential, discounted, or promotional price.

• “Number of Days Used” is calculated from and including the date on which your membership service is activated through and including the date on which you submit your refund application.

If the result calculated using the foregoing formula is less than or equal to zero, you will not be required to pay any additional amount, and XMODhub will not refund any amount to you.

8.3 If you submit a refund application within seven (7) calendar days after activation of the membership service, and XMODhub verifies that you have not substantively used the membership service, XMODhub will fully refund the membership service fee actually paid by you.

8.4 You may submit a refund application by contacting customer service through the customer service interface of the XMODhub Game Modifier. After you complete the applicable identity verification and refund confirmation procedures, XMODhub will refund your membership service fee within thirty (30) business days. The refund will be returned to the payment account used for the original payment.

9. Long-Term Inactive Account Management Rules

9.1 To ensure efficient use of service resources and avoid waste caused by account resources remaining idle for extended periods, if you have not logged in to the XMODhub Game Modifier through your account for three hundred sixty (360) consecutive days, XMODhub shall be entitled to reclaim the account.

9.2 After an account is reclaimed, all rights and benefits under that account, including, without limitation, purchased membership service time, coupons of any kind, virtual items, points, and other value-added services, will be reclaimed at the same time. Fees you have paid in connection with the account will not be refunded, and you may not assert any right or claim against XMODhub arising from the reclamation of the account or its rights and benefits.

9.3 Account reclamation constitutes the final disposition of the account and its data. Once an account has been reclaimed, it cannot be used to log in again or be restored, and XMODhub will no longer provide services for unfreezing or restoring the account or recovering its data.

9.4 To facilitate your continued use of the services, when your account is approaching the reclamation deadline, XMODhub may send you a reminder through the contact information you provided at registration, including, without limitation, by email or SMS. Any such reminder is provided solely as an additional convenience by XMODhub and does not constitute a legal obligation of XMODhub. If your account is reclaimed because you did not receive or timely review the notice, you shall bear the related consequences.

10. Compliance with Local Laws and Regulations

10.1 When using the XMODhub Game Modifier Services, you shall comply with applicable local laws and regulations and respect local morals and customs. If your conduct violates local laws, regulations, morals, or customs, you shall bear sole responsibility therefor.

10.2 You shall avoid causing XMODhub to become involved in political or public events as a result of your use of the XMODhub Game Modifier Services. Otherwise, XMODhub shall be entitled to suspend or terminate the services provided to you.

11. Governing Law and Jurisdiction

11.1 This Agreement is entered into in the Hong Kong Special Administrative Region of the People’s Republic of China.

11.2 The formation, effectiveness, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, excluding its conflict-of-laws rules.

11.3 Any dispute or controversy arising between you and XMODhub out of and/or in connection with this Agreement shall first be resolved through amicable consultation. If such consultation fails, you agree to submit the dispute or controversy to a court of competent jurisdiction in the Hong Kong Special Administrative Region of the People’s Republic of China.

11.4 The headings of all provisions of this Agreement are included solely for ease of reference, have no substantive meaning, and may not be used as a basis for interpreting the meaning of this Agreement.

11.5 If any provision of this Agreement is partially invalid for any reason, the remaining provisions shall remain valid and binding on the parties.

12. Miscellaneous

12.1 XMODhub shall be entitled to amend the terms of this Agreement when necessary. You may review the latest version of the terms of this Agreement on the relevant pages of the XMODhub Game Modifier. If you continue to use the XMODhub Game Modifier Services after the terms of this Agreement are amended, you will be deemed to have accepted the amended Agreement. If you do not agree to an amendment, you shall stop using the services and cancel your account before the amendment takes effect.
